Terms of Service

Sep 25, 2026 ·

1. About these terms

These Terms of Service apply whenever you use blackandwhitepublishingllc.com, read our ubooks, buy a book or subscription, or send us a submission. By doing any of these, you agree to these terms.

“We,” “us” and “our” mean Black & White Publishing LLC, a NY limited liability company, 6720 Rochester Road, Middleport NY, 14105. “You” means the person using the site.

If you don’t agree with these terms, please don’t use the site. Our Privacy Policy explains how we handle your personal information and is part of these terms.

2. Accounts and age

You need an account to buy books or subscribe. You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase.

Many of our books are for children and teens. A parent or guardian may buy books for a child and let them read under their account, and is responsible for that use. We don’t knowingly create accounts for, or collect personal information from, children under 13.

Keep your login details private. You’re responsible for activity on your account, and please tell us right away at [email] if you think someone else has used it.

3. ubooks, free chapters and paid chapters

A ubook is a book presented as a series of video chapters set to original music. The first chapters of each book are free to read on this site and on YouTube. The remaining chapters are available only to readers who buy that book or hold an active All-Access subscription.

Which chapters are free, which books are offered, and what All-Access includes may change over time. Books you have already bought stay available to you, as described in section 5.

ubooks stream online. You need an internet connection and a supported browser, and your internet provider’s data charges may apply.

4. Purchases, subscriptions and refunds

Buying a book. When you buy a book, you pay once and get access to all of its chapters for as long as we offer the ubook service.

All-Access. All-Access is a subscription billed monthly at the price shown when you sign up. It renews automatically at the end of each billing period, charging the payment method on file, until you cancel.

Cancelling. You can cancel All-Access at any time from your account page. Cancelling stops future charges, and you keep access until the end of the period you’ve already paid for.

Price changes. We may change prices. A new subscription price applies from your next billing period, and we’ll email you at least 30 days before it does.

Payments. Payments are processed by PayPal. We don’t store your full card details.

Refunds. [Choose one and delete the other:]

  • Because paid chapters can be read as soon as you buy them, purchases and subscription payments are not refundable, except where the law requires otherwise or a book didn’t work because of a problem on our side.

Nothing in these terms limits any rights you have under consumer protection law.

5. Your license to read

When you have access to a ubook, we give you a personal, non-transferable license to stream and read it for your own non-commercial use, and to share it with your household.

You may not:

  • download, record, screen-capture or copy ubooks, their text or their music
  • share your login, or post, sell, rent or broadcast ubooks
  • show ubooks to a class, library group or audience without a [classroom or institutional license] from us
  • get around the way paid chapters are protected

We may suspend or close an account that breaks these rules. If we close your account for another reason, or stop offering the ubook service, we will [refund the unused part of any subscription and give you reasonable notice].

6. Our intellectual property

The ubook format is patented by Melanie Schulz and is used with her permission by Black and White Publishing LLC. (U.S. Patent No. 11,470,365 B2). Set Books Free and its reading program are also ours.

The books, text, illustrations, music, videos, designs and logos on this site belong to us or to the authors, illustrators and composers we work with, and are protected by copyright and other laws. Apart from the license in section 5, these terms give you no rights to them.

7. Submissions from authors and illustrators

You keep your rights. Sending us a manuscript or artwork does not transfer any rights in it to us. We will only publish your work under a separate written agreement signed by both of us.

What you confirm. By submitting, you confirm that the work is your original creation, that you have the right to share it, and that you are at least 18, or submitting with a parent’s or guardian’s permission.

How we use it. We use your submission only to evaluate it for publication. We keep it private, share it only with the people who review it, and delete it within 12 months if we don’t publish it, or sooner if you ask.

Similar ideas. We receive many submissions and develop our own books. We may already be working on, or later publish, stories with ideas or themes similar to yours. Ideas and themes on their own can’t be owned, and receiving your submission doesn’t stop us from publishing similar work that we develop independently.

Replies. We read every submission and aim to reply within three weeks. We can’t guarantee a reply or give detailed feedback on every submission.

8. Other services we use

Our videos are delivered through Vimeo and YouTube, and payments through Paypal. Those services have their own terms and privacy policies. We aren’t responsible for them, or for other websites we link to.

9. Disclaimers

We work hard to keep the site and ubooks running well, but we provide them “as is.” We can’t promise they will always be available, uninterrupted or free of errors, and to the extent the law allows, we disclaim all warranties not stated in these terms.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses arising from your use of the site. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Governing law

These terms are governed by the laws of the State of NY, without regard to its conflict-of-law rules. Any dispute will be handled in the courts of Niagara County, NY unless the law where you live gives you the right to bring it elsewhere.

12. Changes to these terms

We may update these terms from time to time. We’ll post the new version here with a new date and, for significant changes, email account holders at least 30 days in advance. Continuing to use the site after changes take effect means you accept them.
